Terms of Service

These Terms of Service ("Terms") govern your access to and use of the GlowIntake website and SMS messaging services at glowintake.com (the "Service"), which is operated by GlowIntake ("we," "us," or "our"). By using our Service, you agree to these Terms. If you do not agree, you may not use the Service.

1. Eligibility

You must be at least 18 years of age and a resident of the United States to use our Service. By using the Service, you represent and warrant that you meet these requirements.

2. SMS Messaging Terms & Consent

By submitting the lead capture form on our website and checking the consent box, you affirmatively consent to receive recurring automated SMS messages from GlowIntake at the mobile number you provided. These messages may include appointment updates, treatment information, scheduling assistance, and support communications from our AI intake coordinator.

  • Consent: Your consent is not a condition of any purchase. You may opt out at any time.
  • Message frequency: Message frequency varies. Typically, you will receive between 1 and 10 messages per week related to your inquiry and appointment scheduling.
  • Carrier charges: Standard message and data rates may apply from your mobile carrier. GlowIntake is not responsible for any carrier charges.
  • AI-generated content: SMS replies are generated by an AI intake coordinator and may include general information about aesthetic treatments. This information is not medical advice.

3. Opt-Out Rights (STOP)

How to Opt Out

You may cancel your SMS subscription at any time by replying STOP to any message you receive from GlowIntake. Upon doing so, you will receive a one-time confirmation message, and no further messages will be sent to your mobile number. Opting out does not terminate these Terms or your obligations under them.

4. Support (HELP)

How to Get Help

If you need assistance at any time, reply HELP to any message from GlowIntake to receive support information, including opt-out instructions and contact details. You may also email us at support@glowintake.com.

5. Use of the Service

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others. You agree not to:

  • Use the Service for any fraudulent or unlawful activity.
  • Submit false or misleading information on the lead capture form.
  • Attempt to disrupt, overload, or compromise the Service or its AI systems.
  • Use another person's mobile number without their consent.
  • Reverse engineer, decompile, or otherwise attempt to extract the source of our AI systems.

6. AI-Generated Content

The SMS responses you receive are generated by an artificial intelligence system ("Sarah"). While we strive for accuracy and helpfulness, AI-generated content may contain errors or inaccuracies. AI-generated messages are not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions about a medical condition or treatment.

7. Intellectual Property

The Service, including its content, features, and functionality, is owned by GlowIntake and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from the Service without our prior written consent.

8. Third-Party Services

The Service relies on third-party providers, including Twilio (for SMS delivery) and OpenAI (for AI response generation). We are not responsible for the practices or availability of these third-party services, and their terms and privacy policies apply to your use of those services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED RESPONSES WILL BE ACCURATE OR COMPLETE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GLOWINTAKE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, FOR THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless GlowIntake and its affiliates from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Service or your violation of these Terms.

12. Changes to These Terms

We may revise these Terms from time to time. The most current version will always be posted on this page with the updated "Effective Date." Your continued use of the Service after any changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in the United States.
